Kisumu-based visual artist Collins Omondi Okello, renowned for creating the viral memorial artwork of the late former Prime Minister Raila Odinga, has officially copyrighted the image to secure ownership and control over its commercial use. The artwork, now legally protected under the title “Sunset of the Enigma”, bears copyright number RZ81855, issued by the Kenya Copyright Board (KECOBO).
Protecting Intellectual Property
Okello explained that copyright registration was necessary to prevent exploitation of his work by individuals seeking profit without permission. “This is not an action against reposting or resharing for fair use; it is to protect against unscrupulous commercial use without authority or following copyright guidelines,” he stated.
The digital portrait of Raila Odinga gained viral attention shortly after his passing, inspiring reproductions on merchandise including T-shirts, posters, and digital banners. Despite its widespread popularity, Okello emphasized that the piece was created as a personal tribute rather than a commercial venture. “My main aim of doing this work was as a personal tribute to a global icon who shaped our political landscape. It was never intended for commercial purposes,” he said.

Understanding Copyright in Kenya
Copyright in Kenya is governed by the Copyright Act, 2001 (as amended) and administered by KECOBO. The law protects original works of authorship—including literary, artistic, musical, and audiovisual creations—from unauthorized reproduction, distribution, or commercial exploitation.
By registering a copyright, creators gain exclusive rights to reproduce, distribute, display, and license their work. Anyone wishing to use the artwork commercially must obtain the creator’s permission. While copyright arises automatically upon creation, registration provides legal proof of ownership, crucial for enforcing rights in cases of infringement.
Violations of copyright law can result in civil penalties, fines, and compensation for damages, and in severe cases, criminal prosecution. Okello’s registration of “Sunset of the Enigma” ensures that his tribute to Raila Odinga remains protected, highlighting the importance of safeguarding intellectual property—even for works created out of admiration or respect.
