The High Court has temporarily halted a Ksh 230 million tender awarded by the Kiambu County government after the Ethics and Anti-Corruption Commission (EACC) uncovered massive irregularities, including forged financial statements and falsified employee credentials.
In a ruling delivered by Justice Lucy Njuguna, the court issued orders stopping any further payments related to the contract for 14 days pending a full hearing on November 13, 2025. The injunction followed an urgent application filed by the EACC, which raised concerns over fraudulent documentation submitted by a private firm awarded the lucrative tender.
The tender, advertised on March 30, 2023, was for the development, installation, testing, training, commissioning, and support services of an Enterprise Resource and Planning System (ERP) for the county government. According to the EACC’s report, the company had submitted audited financial statements for 2020, 2021, and 2022 as part of its bid. However, investigations revealed the statements had not been audited by the firm listed in the tender documents.
Further scrutiny by EACC exposed that the bank statements were illegally edited to show a healthy cash flow and profitability, contrary to the company’s actual financial position. The commission also discovered that two individuals listed as key staff members were not employees of the company.
Despite these discrepancies, the firm signed a Ksh 230 million contract on April 24, 2023, which was to run for six months. Later, in December 2023, the firm requested a 52-week extension, citing project complexity. Shockingly, the extension was irregularly approved in February 2024 by a senior county official, even though the original contract had expired.
So far, the company has received Ksh 63 million. The EACC is now seeking to recover the funds and permanently bar Kiambu County from releasing the remaining Ksh 166 million.
The county government has yet to issue an official statement on the matter.
