Politicians who lost in the last general elections or former governors can now apply for positions in the National Land Commission (NLC). This follows a High Court order that temporarily suspends a disqualification rule.
The NLC Selection Panel, chaired by Rehema Jaldesa, published a new call for applications. Previously, Section 8(3) of the NLC Act prevented anyone who had held or contested for MP, MCA, or Governor positions within the last five years from applying.
Jaldesa said the panel is acting in compliance with the High Court.
“We received a court order that suspended this disqualification. We have since complied with the decision,” she said.
Court Suspends NLC Disqualification Rule
On September 2, 2025, High Court Judge Chacha Mwita issued a conservatory order. The order prevents the panel from applying Section 8(3) until September 22, 2025. This allows former politicians to submit applications for NLC roles.
NLC Leadership Changes in November
The current NLC commission, led by Chairperson Gershom Otachi Omwanwa, will exit on November 15, 2025, after completing a six-year term. Other members leaving include James Tuitoek, Getrude Nguku, Reginald Okumu, Samwel Kambi, Hubbie Al-Haji, and Alister Mutugi.
Two members, former Minister Esther Murugi and former Isiolo Woman Representative Tiya Galgalo, were sworn in later on December 20, 2020. Their term was expected to end in December 2026, so it is unclear if they will forfeit the remaining year.
Selection Panel Composition
The NLC Selection Panel includes representatives from government, NGOs, the private sector, and professional bodies. Besides Jaldesa, the members are Jasper Mbiuki, Peris Mang’ira, Dr. Electine Nasambu, Anne Mwangangi, Bibiana Ribuku Omalla, and Nichola Letting.
