The Nairobi City County Government has officially denied reports that it ordered the closure of Naivas Supermarket’s Moi Avenue branch due to allegations of selling expired products. This clarification comes after a statement from the County Assembly Health Committee suggested such action following their inspection on May 13.
Chief Officer for Public Health, Tom Nyakaba, emphasized on Wednesday that the County Executive did not issue any directive to close the supermarket. Nyakaba explained that while the Health Committee recommended closure after their oversight visit, the Executive’s role is to make decisions based on independent assessments and legal frameworks.
Following the committee’s visit, an independent follow-up assessment was conducted by the Director of Environmental Health, Anthony Muthemba. Muthemba’s evaluation concluded that the issues identified at the supermarket did not meet the legal threshold for immediate closure under the Food, Drugs and Chemical Substances Act, Cap 254. As a result, the County Executive determined that Naivas should remain operational while compliance matters and necessary documentation are reviewed administratively.
Nyakaba reiterated that any suspension or closure of food establishments must adhere to due process, relying on evidence-based technical standards and legal provisions. This mandate lies solely with the County Executive, who remains committed to ensuring food safety and protecting public health in Nairobi.
Responding to the allegations, Naivas Supermarket branded the claims as false, misleading, and damaging to its reputation. The retailer reassured customers and stakeholders that no expired products were found during the inspections and highlighted their stringent internal quality control and stock management systems across all branches. Naivas confirmed that none of its stores have been closed by any regulatory authority and that all outlets comply with standards set by the Kenya Bureau of Standards (KEBS), Ministry of Health, and other relevant bodies.
Naivas also revealed it is seeking legal advice regarding possible action against those spreading misinformation. The retailer reiterated its firm stance against bribery and corruption, stating it will not succumb to extortion attempts.
