Chief Justice Martha Koome has officially announced the Supreme Court’s December recess, scheduled to begin on Sunday, December 21, 2025, and run until Tuesday, January 13, 2026, both days inclusive. The announcement was made through a Gazette notice dated November 21, 2025.
The recess is anchored in Article 163(1)(a) of the Constitution, as well as sections 6A and 29D of the Supreme Court Act, 2011, and Rules 4, 5 and 7 of the Supreme Court Rules, 2020. These provisions outline when the court may take scheduled breaks from its regular sittings.
Despite the recess, CJ Koome assured Kenyans that judicial services will not come to a halt. A duty judge will remain available throughout the period to handle urgent applications and time-sensitive matters. In addition, the Supreme Court Registry will stay open on weekdays from 8:30 am to 5:00 pm, except on public holidays, ensuring continuous access to filings and essential services.
The latest announcement also revoked Gazette Notice No. 15209 of 2025, following an updated communication issued on October 22, 2025.
In a related development, the Chief Justice issued a separate notice on November 13, 2025, establishing the Chepkemel Magistrate’s Court. The new court, which begins operations on December 1, 2025, will operate under the supervisory jurisdiction of the Kericho High Court. Its opening is expected to ease pressure on neighbouring courts and improve access to justice for residents of Chepkemel and nearby areas.
Judicial recesses are essential periods where courts pause regular hearings, allowing judges dedicated time to write pending judgments, address complex cases, and handle administrative duties. Although normal sessions take a break, the Judiciary continues to function, ensuring Kenyans still receive timely and efficient services.
Through these measures, CJ Koome reaffirmed the Judiciary’s commitment to expanding access to justice and enhancing efficiency across the country.
