A Milimani court has issued a summons to the investigating officer in the cybercrime case involving social media influencer Francis Gaitho, following persistent delays and no-shows that have stalled proceedings. The order was made on July 14, 2025, by Chief Magistrate Susan Shitubi during a mention of the case.
The court directed the officer to appear in person, and the matter was adjourned to August 12, 2025. The move is the latest in a series of legal actions aimed at pushing forward a case that has faced repeated interruptions.
Gaitho is facing charges related to publishing false information, stemming from a post made on July 15, 2024, during the height of the Gen Z protests. In the post shared on X (formerly Twitter), Gaitho claimed that the Directorate of Criminal Investigations (DCI) had arrested the wrong suspect in the notorious Kware murders an assertion prosecutors say could mislead the public and interfere with investigations.
The murders, which shocked the nation, involved the discovery of multiple bodies of women in the Kware area of Nairobi. Police had arrested Collins Jumaisi, who reportedly confessed to the crimes. However, Jumaisi later escaped from custody at Gigiri Police Station and remains at large.
According to the charge sheet, Gaitho’s social media post was framed as a factual statement and had the potential to obstruct justice. A second charge alleges that he published information which could expose an innocent individual to public harm.
Although Gaitho pleaded not guilty and was granted a cash bail of Sh30,000, his continued absence from court prompted the issuance of a warrant of arrest by Senior Principal Magistrate Robinson Ondieki on June 30, 2025.
With the prosecution expressing frustration over the slow progress, the court’s decision to summon the investigating officer signals a renewed effort to ensure accountability and momentum in the high-profile cybercrime case. The August hearing is expected to provide direction on the way forward.
