The Law Society of Kenya (LSK), Busia Chapter, has called on the Chief Justice to urgently transfer Chief Magistrate Edna Nyaloti from the Busia Law Courts, citing serious security concerns.
In a statement released on Monday, LSK Busia Chapter Chairperson Dolan Nabulindo expressed deep alarm over the safety of judicial officers in the county, emphasizing that the right to life, as enshrined in the Constitution, must be protected. “The Law Society of Kenya, Busia Chapter, acknowledges the right to life as enshrined in our Constitution, a right we all cherish and defend. Equally, we are concerned with the safety of Chief Magistrate Nyaloti, and urgent intervention is necessary,” Nabulindo said.
The concerns, according to Nabulindo, have begun to undermine confidence in the independence and security of the judiciary in Busia. She revealed that advocates within the county have already resolved to boycott court proceedings presided over by Nyaloti if swift action is not taken. “If Chief Magistrate Nyaloti is not transferred within the next 21 days, advocates shall withdraw their services in all courts within Busia County, including the newly established Malaba and Port Victoria Law Courts,” she warned.
The call for a transfer follows reports that unknown individuals allegedly approached the magistrate’s residence at night and issued threats. In response, Chief Magistrate Nyaloti has formally written to both the Chief Justice and the Inspector General of Police, requesting thorough investigations and enhanced personal security measures.
Nabulindo stressed that the request goes beyond individual protection, highlighting the broader implications for the justice system. “The transfer is not just about one officer’s safety, it’s about preserving the integrity and independence of the entire justice system in Busia,” she noted.
The LSK Busia Chapter reaffirmed its commitment to upholding the rule of law and safeguarding judicial officers across the county. The Office of the Chief Justice and the National Police Service have not yet issued an official response regarding the request.
As the deadline approaches, the legal fraternity and residents of Busia are keenly watching how swiftly the judiciary and security agencies will act to ensure the safety of judicial officers and the continued functioning of the justice system in the county.
