President William Ruto’s advisor on Constitutional Affairs, Prof. Makau Mutua, says he will resign if the government acts against his conscience.
Speaking on Citizen TV on Wednesday night, Mutua stressed that he is not in government to “whitewash” or cover up wrongdoing.
Loyalty to Truth, Not Blind Service
Mutua explained that his value to President Ruto lies in his ability to speak truthfully.
“If things happen that I am not happy with, or that my conscience cannot live with, I will move out,” he said.
He added that he would be of no use to the President if he could not give honest advice. His loyalty, he said, lies in honesty and accountability, not blind loyalty.
A Role Anchored in Accountability
Mutua, a known ally of ODM leader Raila Odinga, joined Ruto’s administration after a broad-based agreement between the United Democratic Alliance (UDA) and the Orange Democratic Movement (ODM).
Apart from his advisory role, Mutua also chairs the Panel of Experts on Compensation of Victims of Demonstrations and Public Protests. The 18-member panel is tasked with reviewing claims and recommending reparations.
The Team Behind the Compensation Panel
The panel includes:
- Faith Odhiambo (Law Society of Kenya president) – Vice Chairperson
- Kennedy Ogeto

Richard Barno serves as Technical Lead, with Duncan Ndeda as Co-Technical Lead. Jerusah Mwaathime and Raphael Ng’etich are joint secretaries.
A Stand on Principle
Mutua’s remarks underline his belief that public service must be grounded in truth and accountability. His strong stand shows he is ready to walk away if his principles are compromised.
