Pastor Robert Burale has suffered a legal setback after a Nairobi court declined to grant his request to have a controversial YouTube interview by his ex-wife, Rozina Mwakideu, deleted from online platforms.
The interview, titled “My Biggest Mistake Was Marrying Robert Burale,” was uploaded on October 4 to a YouTube channel owned by Rozina’s brother, radio personality Alex Mwakideu. The video has since gone viral, attracting over 815,000 views and sparking intense online debate about relationships and faith.
Burale sued both Rozina and Alex, accusing them of defamation and seeking Ksh.20 million in damages. In his petition, Burale argued that the video portrayed him in a negative and damaging light, and urged the court to have it permanently pulled down.
However, Milimani Commercial Chief Magistrate Thomas Nzyoki declined to issue an order for the removal of the video. Instead, the court granted an interim injunction restraining both Rozina and Alex from making any further publications or reposting the disputed video until the case is heard and determined.
“An order for interim injunction is granted to stay the defendants from any further publication of the complained video on any social media platform pending the hearing and determination of the application,” ruled Magistrate Nzyoki.
The Magistrate clarified that the ruling only applies to future publications, meaning the existing video will remain online.
Lawyer Ochiel Dudley, representing the Mwakideu siblings, assured the court that his clients would fully comply with the court’s directive.
The case will proceed to a full hearing, where the court will determine whether the video amounts to defamation and if Burale deserves compensation.
