The Ethics and Anti-Corruption Commission (EACC) has objected to an application by the Office of the Director of Public Prosecutions (ODPP) seeking to withdraw a corruption case against a senior University of Nairobi (UoN) official accused of forgery and fraudulent enrichment.
The official, Daniel Brian Ouma Okeyo, is accused of forging academic documents and unlawfully obtaining more than Ksh32 million in salaries and benefits while serving in senior administrative positions at the university. His roles allegedly included Deputy Director (Fundraising, Donor Relations and Partnership), Director of Advancement, and Acting Chief Operations Officer between 2015 and 2025.
During a session before the Anti-Corruption Court on Tuesday, the prosecution informed the court of its intention to terminate the proceedings. However, EACC lawyers immediately opposed the move, terming it premature given the existence of active conservatory court orders protecting the accused.
According to the Commission, these orders issued on July 9 stem from petitions Okeyo filed in both the High Court and the Labour Court, where EACC and ODPP are listed as respondents. The EACC argued that the petitions have not been withdrawn, making it inappropriate to end the criminal case prematurely.
“The said petitions have not been withdrawn, and it would only be appropriate for the accused to first withdraw those matters before any steps are taken in this case,” an EACC representative told the court.
The Commission warned that terminating the case before resolving the related petitions would undermine the judicial process.
In response, the prosecution said discussions were ongoing to address the outstanding legal matters and assured the court that the case would only be dropped after those issues were fully settled.
The court has scheduled its ruling on the withdrawal application for October 30.
If found guilty, Okeyo faces charges of forgery and unlawful acquisition of public property under the Anti-Corruption and Economic Crimes Act.
