The Ethics and Anti-Corruption Commission (EACC) has filed a lawsuit seeking to recover Ksh813 million from Kiambu Governor Kimani Wamatangi and 13 others over allegations of corruption and irregular tender awards.
According to the EACC, investigations revealed that the funds were obtained through irregular payments from the Kenya National Highways Authority (KeNHA), the Kenya Urban Roads Authority (KURA), and the Kenya Rural Roads Authority (KeRRA) between the 2018/19 and 2021/22 financial years.
The anti-graft body claims that Governor Wamatangi abused his position as Chairperson of the Senate Standing Committee on Roads, Transportation, and Housing to influence the award of road construction tenders to five companies linked to him.
EACC further alleged that these firms used forged bid documents and falsified technical qualifications to secure lucrative government contracts. Out of the total funds, more than Ksh726 million reportedly came from KeNHA and KURA, while Ksh86 million was disbursed by KeRRA.
The commission maintains that the payments were unlawful and constituted proceeds of corruption. It added that Wamatangi concealed his ownership in the companies by transferring directorships to relatives and proxies, while still maintaining control of the firms’ bank accounts. Investigators reportedly established that he remained a signatory to the accounts, making him the beneficial owner and main recipient of the funds.
“Investigations revealed a clear pattern of concealment and abuse of office designed to misappropriate public funds through fraudulent tenders and false declarations,” EACC stated.
The case has been filed at the Milimani Anti-Corruption Court, where Governor Wamatangi and the 13 co-defendants have been listed as respondents. Lady Justice Lucy Njuguna has scheduled the hearing for November 18, 2025, when all parties are expected to appear for the proceedings.
