A health centre supervisor from Vihiga County has been arraigned before the Milimani Law Courts over allegations of conspiring to defraud the Social Health Authority (SHA) of more than Ksh5 million.
The accused, identified as Markdhillion Sydon Mutsotso, a supervisor at St Mark Orthodox Health Centre in Chavakali, faces two counts — conspiracy to defraud and falsification of medical documents. According to the prosecution, Mutsotso and others who were not present in court between October 2024 and June 2025 conspired to defraud SHA of Ksh5,128,400 through falsified claims.
The charge sheet detailed that the accused, with intent to deceive, jointly with others still at large, manipulated medical documentation to make false claims. These actions were allegedly carried out under the guise of providing medical treatment to patients who, in reality, never received the reported services.
In the second count, Mutsotso and another suspect, identified as Fenley Ngairah Desounza, are accused of falsifying patient health records and claim forms with the intention of fraudulently obtaining funds from SHA. The prosecution indicated that the duo knowingly inserted fake patient details into medical claim documents to misrepresent that treatments had been conducted, contrary to the provisions of the Social Health Insurance Act.
When arraigned before Milimani Chief Magistrate Lucas Onyina, Mutsotso pleaded not guilty to both charges. In his defence, he appealed for lenient bail terms, stating that he was a young employee earning a modest monthly salary of Ksh40,000 and was not a flight risk. He assured the court that he had a fixed place of residence and would comply with all court proceedings.
The prosecution did not oppose his release on bail but requested that the court impose strict conditions given the seriousness of the charges. Magistrate Onyina subsequently granted Mutsotso a bond of Ksh200,000 with one surety of a similar amount or an alternative cash bail of Ksh70,000.
Meanwhile, the court issued warrants of arrest against two other accused individuals, Fenley Desounza and another identified as Sammy, who failed to appear for plea taking. The case is set to be mentioned on October 21, 2025, for further directions as investigations into the alleged multi-million-shilling SHA fraud continue.
