The High Court has dismissed former Kiambu Governor Ferdinand Waititu’s request to review his 12-year prison sentence.
Justice Lucy Njuguna made the ruling on Tuesday, September 16, 2025. She said the sentence would remain in place until the hearing of Waititu’s appeal.
Conviction Over Corruption
Waititu was convicted in February 2025. The court found him guilty of failing to safeguard public funds.
Investigations showed that he irregularly received Ksh. 25 million from Testimony Enterprises. The money came after an unlawful tender award.
The court ordered him to pay a fine of Ksh. 53.5 million or serve 12 years in jail. Since he failed to raise the fine, he remains in prison.
DPP Opposed the Review
In August, Waititu filed an application to have the sentence reviewed. The Director of Public Prosecutions (DPP) opposed the request. The DPP argued that the conviction was based on strong evidence.
Justice Njuguna agreed. She ruled that the judgment stands as delivered.
Appeal Must Be Heard Within 120 Days
The judge directed that Waititu’s appeal be heard within 120 days. She warned against unnecessary delays, adding that stalling tactics could lead to dismissal of the appeal.
Waititu is currently being held at Kamiti Maximum Prison. He has not secured bond. His case will be mentioned again on October 1, 2025.
A Strong Message on Accountability
The ruling shows the court’s firm stand on corruption cases. It also sends a warning to leaders that misuse of public resources comes with serious consequences.
For now, Waititu’s 12-year sentence remains in force as Kenyans wait to see how his appeal will unfold.
