A Webuye court has sentenced Benard Musindi to life imprisonment after finding him guilty of multiple counts of sexual violence, including incest and child abuse.
The conviction, delivered on August 28, 2025 by Webuye Principal Magistrate Viola Biwott, followed harrowing testimony and medical evidence presented in court.
The case stemmed from an incident on September 16, 2024, when members of the public discovered an 8-year-old girl crying outside her uncle’s house in Bungoma County. The minor, who was visibly distressed and struggling to walk, revealed she had been defiled by her uncle.
She was rushed to hospital for treatment as the matter was reported to authorities. Officers from the DCI Anti-Human Trafficking and Child Protection Unit swiftly arrested Musindi and arraigned him at the Webuye Law Courts.
He faced:
- Two counts of incest under Section 20(1) of the Sexual Offences Act, 2006,
- One count of deliberate transmission of a life-threatening sexually transmitted disease contrary to Section 26(1)(c),
- Child abuse under Section 22(1)(b), read with Section 22(2) of the Children Act, 2022.
The DCI welcomed the life sentence, hailing it as a product of meticulous investigation and seamless cooperation within the criminal justice system.
“This judgement underscores our unwavering commitment to ensuring justice for victims of sexual and gender-based violence,” the agency said in a statement.
