A petition filed by Nairobi Central OCS Samson Kiprotich Talaam seeking to stop his prosecution over the murder of teacher and blogger Albert Omondi Ojwang has been transferred to the High Court in Kibera.
The petition was initially filed at the Constitutional and Human Rights Division of the Milimani Law Courts following Talaam’s arraignment on June 16, 2025, in a miscellaneous application brought by the Independent Policing and Oversight Authority (IPOA). However, both the Directorate of Public Prosecutions (DPP) and IPOA requested that the matter be heard in Kibera, where other suspects linked to the same case are being processed.
The High Court granted the application, noting that continuing with the petition at Milimani could result in conflicting court decisions. The judge ruled that the case file be moved to Kibera to allow for a coherent judicial process, since other suspects had already been charged there.
OCS Talaam, along with Police Constable James Mukhwana, Peter Kimani alias Kim, John Ngige Gitau alias Kinara, Gin Ammitou Abwao alias Gilbeys, and Brian Mwaniki Njue, have been charged with the murder of Ojwang. The DPP alleges that the suspects, together with others not before the court, committed the murder on the night of June 7 to June 8, 2025, between 9:30 PM and 2:00 AM, at the Central Police Station in Nairobi.
The six are charged with murder contrary to Section 203 as read with Section 204 of the Penal Code. The case documents state that the accused acted jointly in committing the offence.
On June 24, 2025, the court ordered that Talaam and four co-accused remain in custody pending the submission of a pre-bail report. The judge further directed that all accused undergo mental assessment to determine their fitness to stand trial.
One of the accused, Police Constable James Mukhwana, was directed to be held at Capitol Hill Police Station to allow further investigations specific to his involvement in the incident.
