Two police officers have been found guilty of murdering Dennis Lusava, a man who was tortured to death while in custody at a police post in Kakamega County. The High Court delivered the verdict, ruling that the prosecution had proven the case beyond a reasonable doubt against the two constables, Emmanuel Wafula Vyambaka and Godwine Wekesa Siirengo.
The court heard that Lusava was arrested on October 4, 2022, and taken to Mbururu Police Post. Witnesses testified that he was visibly injured while in custody. One witness reported hearing him pleading for his life, while another saw him tied to a window inside the station. On October 7, when Lusava’s mother returned to inquire about his release, officers told her he had already been released. Days later, his body was discovered dumped in the River Nzoia.
Scientific evidence, including DNA samples from the deceased, was found in a hired vehicle used to transport and dispose of his body, firmly linking the two officers to the crime. The court was also presented with testimony from 21 witnesses and 27 exhibits, including medical and forensic reports.
The judge noted that there was no evidence of any confrontation or provocation that could have justified the use of force. Testimonies revealed that Lusava was beaten with electric cables, kicks, and blows. A doctor who examined him testified hearing screams from Lusava in the station, followed by silence. Despite attempts by Lusava’s mother to post a cash bond for his release, her offer was rejected.
Evidence presented in court showed that the two officers conspired to cover up the murder. They allegedly used a friend to lure Lusava back to the station, where he was brutally assaulted. Later, they transported his body to Webuye and dumped it in the river. In an attempt to conceal the crime, they altered the police Occurrence Book to falsely indicate that Lusava had been released earlier.
A post-mortem report confirmed that Lusava died from extensive physical injuries leading to circulatory failure. The court concluded that the murder was premeditated and executed with malice aforethought. It ruled that only the Mbururu Police Post could account for the injuries Lusava sustained.
With the guilty verdict delivered, the court canceled the officers’ bail and ordered their remand in custody. Sentencing is scheduled for July 9, 2025. The case has raised serious concerns about police brutality and abuse of power, underscoring the need for accountability and reform within law enforcement.
